YEARLY LLC (“us”, “we”, or “our”) operates the www.yearly.eco website and the YEARLY mobile application (the “Service”). For your child to have their own Yearly account or profile, we may need your permission to collect, use or disclose your child’s information as described in this Privacy Policy. When you allow your child to use our platform, you and your child are trusting us with your information. We understand this is a huge responsibility and work hard to protect their information and put you in control. This Privacy Policy does not apply to the practices of any third party apps, actions or websites that your child may use. You should review the applicable terms and policies for third party apps, actions, and sites to determine their appropriateness for your child, including their data collection and use practices.

INFORMATION WE COLLECT

Once you grant permission for your child to have a Yearly profile, their account or profile will generally be treated like your own with respect to the information that we collect. For example, we collect:

Information you and your child create or provide to us.

As part of the account and profile creation process, we may ask for personal information like first and last name, email address, grade, and birthdate. We collect the information you or your child provide, such as your online contact details, which are necessary for us to contact you to request consent. We also collect the information your child creates, uploads, or receives from others when using their account or profile, such as when your child saves a profile picture in their school yearbook.

Information we get from your child’s use of our services.

We automatically collect and store certain information about your child.

This information includes:

Your child’s apps, browsers & devices

We collect information about the apps, browsers, and devices your child uses to access Yearly, including unique identifiers, browser type and settings, device type and settings, operating system, mobile network information including carrier name and phone number, and application version number. We also collect information about the interaction of your child’s apps, browsers, and devices with our services, including IP address, crash reports, system activity, and the date, time, and referrer URL of your child’s request.

Your child’s activity

We collect information about your child’s activity in our services. Your child’s activity information that we collect may include things like quiz results, profile data, and Time Capsule information entered. Your child can visit their Yearly account to manage information that’s saved in their account or profile and you can also manage their profile information by signing in to your child’s Yearly account.

Your child’s location information

We DO NOT collect information about your child’s location when they use our services. Your child’s location can only be shared if they enter their city, state, and/or country on their profile.

We use various technologies to collect and store your child’s information, including local storage, such as browser web storage or application data caches, databases, and server logs. We do not require your child to provide more personal information than is reasonably necessary to use Yearly and services available for these accounts or profiles.

HOW WE USE INFORMATION WE COLLECT

In general, we use your child’s information: to provide, maintain, and improve our services; to develop new services; to customize our services for your child; to measure performance and understand how our services are used; to communicate directly with your child in relation to our services; and to help improve the safety and reliability of our services.

We use different technologies to process your child’s information for these purposes. We analyze your child’s content to help us detect abuse such as spam, malware, and illegal content. When we detect spam, malware, illegal content, and other forms of abuse on our systems in violation of our policies, we may disable their account or profile or take other appropriate action. In certain circumstances, we may also report the violation to appropriate authorities.

INFORMATION YOUR CHILD CAN SHARE

Your child may be able to share information, including photos, preferences, biographical data, and city and state, with others in their school, when signed in with their Yearly account or profile. When your child shares information publicly, it is not accessible through search engines like Google Search.

INFORMATION YEARLY SHARES 

Information we collect may be shared outside of Yearly in limited circumstances. We do not share personal information with companies, organizations, and individuals outside of Yealry except in the following cases:

With consent

We will share personal information outside of Yearly with consent (as applicable).

With their school

Your child’s information, including their name, photo, biographical information they choose to provide, and quiz results may be shared with members of your school on Yearly.

For external processing

We provide personal information to our affiliates to process it for us, based on our instructions and in compliance with this Privacy Policy.

For legal reasons

We will share personal information with companies, organizations or individuals outside of Yearly if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to:

meet any applicable law, regulation, legal process or enforceable governmental request;

enforce applicable Terms of Service, including investigation of potential violations;

detect, prevent, or otherwise address fraud, security or technical issues; or

protect against harm to the rights, property or safety of Yearly,  our users or the public as required or permitted by law.

We may also share non-personally identifiable information (such as trends about the general use of our services) publicly and with our partners — like publishers, advertisers, developers, or rights holders. For example, we share information publicly to show trends about the general use of our services.

ACCESS TO YOUR CHILD’S PERSONAL INFORMATION

If your child has a Yearly profile, you can access, update, remove, and restrict the processing of your child’s information by signing into their Yearly account. If you do not remember your child’s password, you can reset it. Once signed in, you can help manage your child’s privacy settings and information.

If at any time you wish to stop further collection or use of your child’s information, you can delete your child’s Yearly profile by emailing info@yearlly.eco. Your child’s account or profile information will be permanently deleted within a reasonable period of time.

We use your Personal Information for providing and improving the Service. By using the Service, you agree to the collection and use of information in accordance with this policy. While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. We collect this information for the purpose of providing the Service, identifying and communicating with you, responding to your requests/inquiries, and improving our services.

Your contact information may be shared with your coordinating institution. We may provide your Personal Information in order for your school/university/group to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from by following the unsubscribe link or instructions provided in any email sent or by contacting them directly.

LOG DATA

We may also collect information that your browser sends whenever you visit our Service or when you access the Service by or through a mobile device (“Log Data”).

This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages and other statistics.

When you access the Service by or through a mobile device, this Log Data may include information such as the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use and other statistics.

In addition, we may use third party services such as Google Analytics that collect, monitor and analyze this type of information in order to increase our Service’s functionality. These third party service providers have their own privacy policies addressing how they use such information.

Cookies are files with a small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a web site and transferred to your device. We use cookies to collect information in order to improve our services for you.

BUSINESS TRANSACTION

If  YEARLY LLC is involved in a merger, acquisition or asset sale, your Personal Information may be transferred as a business asset. In such cases, we will provide notice before your Personal Information is transferred and/or becomes subject to a different Privacy Policy.

The security of your Personal Information is important to us, and we strive to implement and maintain reasonable, commercially acceptable security procedures and practices appropriate to the nature of the information we store, in order to protect it from unauthorized access, destruction, use, modification, or disclosure.

However, please be aware that no method of transmission over the internet, or method of electronic storage is 100% secure and we are unable to guarantee the absolute security of the Personal Information we have collected from you.

Your information, including Personal Information, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.

If you are located outside United States and choose to provide information to us, please note that we transfer the information, including Personal Information, to United States and process it there.

This Privacy Policy is effective as of November 1, 2023 and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page.
